On 03rd October 2007, Magistrate Court, Ja-ela temporarily suspended the constructions of the Church at Croos Watta in Kotugoda parish and granted permission only to conduct Catechism classes and to celebrate the Holy Mass on Saturday evening.
Church at Croos Watta in Kotugoda parish was built in 2003 and the extension of the church was started on 03rd February 2007.
Some Buddhist extremists in the area protested against the extension and when the Parish Priest Fr. Chryshantha Fernando OMI and the Episcopal Vicar for the Northern Region Very Rev. Fr. Susith Silva visited the church on Friday the 28th September 2007, the chief Buddhist monk in the temple and some extremist Buddhists have threatened not to proceed with the construction. |

Having appealed to the Magistrate Courts, Ja-ela today, the Magistra after listening to the both the parties, appealed to settle the religious amicably and temporary suspended the constructions of the church, granting permission to conduct the Catechism Classes - Dham Pasal and to celebrate the Holy Mass. Also gave orders to the Ja-ela police to maintain law and order in the area and to arrest if anyone threantens the religious services conducted in the church.
While there were 40 priests sitting at the Courts to hear the presentations of the Lawyers, there were also Buddhist monks.
There are 297 Catholic families living around the church and the lawyer appearing for the Buddhists claimed that there are 348 Buddhist families in that area. Magistra pointed out even if there are two Catholics, they have the right to practice their faith.
Presidential Lawyer Hon. Rienzie Arsakularatne appearing on behalf of the Catholics appealed to the Courts to grant permission to conduct religious services, Masses and Sunday School Classes, until the case is settled in the Courts.
1978 Constitution of Sri Lanka, Chapter III, Art. 10., says, that " Every person is entitled to freedom of thought, conscience and religion, including the freedom to have or to adopt a religion or belief of his choice." |

" Everyone has the right to freedom of thought, conscience and religion; this right includes freedom to change his religion or belief, and freedom, either alone or in community with others and in public or private, to manifest his religion or belief in teaching, practice, worship and observance. " |
| Next hearing of the Case is due on 31st October 2007 at the Ja-ela Magistrate Courts. |
